The Court issues an order creating a Claim Form and Proof of Claims Procedures

The Court approves the settlement with Exxon.

On October 7th, the Court approved the settlement of the case with Exxon. It also approved class counsel's request for attorney's fees and for the reimbursement of costs advanced. The Court has also set December 3rd as the date for it to hear argument on the claims procedure for the class

18 August, 2003

The Court approves notice of the settlement to class members and sets October 7th as the date for the Fairness Hearing. The notice will appear for 6 weeks, once per week, in the following papers: Aiken Standard, Charleston Post & Courier, Beaufort Gazette, The State, Orangeburg Times & Democrat, Greenville News, Spartanburg Herald, The Sun News.

Mary Louise Fairey settles case against Exxon.  The case was filed on behalf of all real property owners in S.C. who had their real property contaminated by Exxon service station operations.

This site has been created by counsel for this Class Action to assist Class members in having access to the latest information on the settlement of this class action, to provide them with easy access to case related material and to assist them in the claims procedures.    Case History

On September 18, 1992, Mary Louise Fairey commenced this class action action against Exxon for damages it had caused to her property and all other property which Exxon's service station operations had damaged in South Carolina. Ten years and ten months later, on July 18, 2003, this action was settled just after the trial of the case had begun. The settlement has now received final Court approval. The Court conducted a Fairness Hearing on October 7th to determine if it would continue the preliminary approval it gave to the settlement on July 18th.    Claims Procedures

With approval of the settlement and the issuance of claims procedures, a substantial fund is now available for the claims of qualifying class members. This web site has been updated to describe the claims process and the procedures that will allow persons to file claims against the settlement fund.
